Job Description and Duties
The Office of Legal Affairs (OLA), Employment Advocacy and Prosecution Team (EAPT) is responsible for operation of the Vertical Advocacy Model associated with employee disciplinary matters and matters relating to the Department’s internal affairs investigations designated through the Office of Internal Affairs.
Under the general direction of the Chief Deputy General Counsel, EAPT, the Assistant Chief Deputy General Counsel is responsible for supervising and managing the operations of the EAPT and for overseeing EAPT attorneys on matters designated for investigation oversight. The Assistant Chief Deputy General Counsel organizes, directs, coordinates and monitors EAPT’s legal caseloads; recommends policy impacting the General Counsel; recommends policy impacting the operations of EAPT or OLA; exercises independent judgement to resolve complex issues with statewide impact; and may act in the absence of the Chief Deputy General Counsel. The Assistant Chief Deputy General Counsel directly supervises EAPT’s Assistant General Counsels (AGC) and attorneys assigned to review and designate cases for investigation.
This position receives a $900 monthly differential pay and is eligible for hybrid telework. Employees may work at any EAPT office in Sacramento, Bakersfield, or Rancho Cucamonga and in-office work will be required at times. The Department will provide a laptop and cell phone.

Working Conditions
The Office of Legal Affairs offices are located in Rancho Cordova, Bakersfield, and Rancho Cucamonga. At the time of appointment, the successful candidate will be assigned to one of these three offices as their home office to which they would report when in-office work is required.
Telework
This position is eligible for a hybrid telework schedule for employees who can satisfactorily perform their essential work functions independently and remotely. Specific telework schedules may be discussed further during the interview process. Telework is only available to California state residents who reside and remain in the state. In office work at one of the three office locations will be required at times in accordance with the Statewide Telework Policy.
Travel
On occasion, travel will be necessary to a CDCR institution or location throughout the state for site inspections or interviews, SPB appearances, and court appearances. Days of work may include any day of the week, and hours may include non-standard business hours.
Travel is compensated in accordance with the State Administrative Manual and CDCR travel policies.

General Qualifications

Applicants must demonstrate the ability to perform high administrative and policy – influencing functions effectively. Such overall ability requires possession of most of the following more specific knowledge and abilities:
- Knowledge of the organization and functions of California State Government including the organization and practices of the Legislature and the Executive Branch; principles, practices, and trends of public administration, organization, and management; techniques of organizing and motivating groups; program development and evaluation; methods of administrative problem solving; principles and practices of policy formulation and development; and personnel management techniques; the department’s or agency’s Equal Employment Opportunity Program objectives; and a manager’s role in the Equal Employment Opportunity Program.
- Ability to plan, organize, and direct the work of multidisciplinary professional and administrative staff; analyze administrative policies, organization, procedures and practices; integrate the activities of a diverse program to attain common goals; gain the confidence and support of top level administrators and advise them on a wide range of administrative matters; develop cooperative working relationships with representatives of all levels of government, the public, and the Legislature and Executive branches; analyze complex problems and recommend effective courses of action; and prepare and review reports; and effectively contribute to the department’s or agency’s Equal Employment Opportunity objectives.
These knowledge and abilities are expected to be obtained from the following kinds of experience with substantial participation in the formulation, operation and/or evaluation of program policies (experience may have been paid or volunteer; in State service, other government settings, or in a private organization):
CEA Level A - Responsible for broad administrative and program activities, including the execution and/or evaluation of program policies.
CEA Level B - Responsible for extensive managerial and program administration or broad program manager experience with substantial participation in the formulation, operation, and/or evaluation of program policies.
CEA Level C - Responsible for extensive highly professional influence and contributes to program, policy, and the methods to provide professional services needed to set policies, to meet the mission of the State department and often exercising technical and or professional skills that are required at this level.
Desirable Qualifications
In addition to evaluating each candidate's relative ability, as demonstrated by quality and breadth of experience, the following factors will provide the basis for competitively evaluating each candidate:
- Experience in the management of a large group of legal professionals; and experience in the formulation and implementation of policies and processes for a large legal program.
- Knowledge of legal principles involving employment law and employee discipline, particularly with respect to peace officers, as well as knowledge of legal research methods, court procedures, rules of evidence and procedures, and the conduct of proceedings before courts or administrative bodies related to employment law matters, including disciplinary actions and processes.
- Demonstrated ability to review and revise written work-product of attorneys containing complex legal and factual analyses and to provide constructive feedback in a positive manner that promotes clear and concise final work-product and serves the interests of CDCR.
- Demonstrated ability to evaluate complex legal, administrative and personnel problems and to present solutions and proposals clearly and logically, both orally and in writing; and ability to recommend and/or implement an effective course of action in legal, administrative and personnel proceedings.
- Leadership skills and experience which demonstrate the ability to motivate staff and promote team cohesion; and knowledge of the manager's role in providing equal employment opportunities in the workplace. Demonstrated ability to work cooperatively, and effectively communicate, with internal and external stakeholders including high-level executives within CDCR and within the Legislative and Executive Branches of government.

Examination Information
This examination will consist of a review by an executive screening committee of the candidates' Statement of Qualifications (SOQ). Candidates will be competitively ranked according to their qualifications using predetermined evaluation criteria consistent with the minimum and desirable qualifications for the position. An SOQ is a narrative discussion addressing specific statements, of which are aligned with the desirable qualifications of the position, that demonstrate the candidate’s education, training, experience, and skills. The SOQ also serves as documentation of each candidates' ability to present information clearly and concisely in writing.
Statement of Qualifications Examination Instructions:
- All interested applicants must submit a completed SOQ with their application package.
- The SOQ must not be more than three (3) pages in length, should be single-spaced and typed in 12-point Arial font.
- The SOQ must be numbered and restated in the same order as the statements below and your responses should provide detailed examples of your experience.
- Describe your experience managing a large group of legal professionals. Describe your experience formulating and implementing policies and processes for a large legal program.
- Describe your knowledge of and experience with legal principles involving employment law, employee discipline, and employment discipline laws related to peace officers, including your knowledge and experience with the conduct of proceedings before courts and administrative bodies related to employment law matters, including disciplinary actions.
- Please describe your leadership philosophy and how you have led and motivated diverse, high-performing teams, while fostering a culture of innovation, creativity, and accountability for all team members, and provide examples.
- Describe an experience in which you professionally met with and assisted high-level executives or stakeholders with resolving complex or high-profile legal issues.
- Describe an experience where you have been presented with and resolved a complicated personnel management issue, without including any personal information that could identify the individuals involved.
